I. WHEREAS I am the absolute owner of the Property bearing No.___, [Details] , more fully described in the Schedule below and hereinafter referred to as the "SCHEDULE PROPERTY";

 

II. WHEREAS I am desirous of constructing on the Schedule Property and accordingly entered into a Developmental Contract with my _______________________ and in terms of the said agreement and for that purpose and for the purpose of attending to the several formalities of the Government Department, I am appointing Agent and Attorney in connection with general, miscellaneous and for obtaining sanctions, licences, permissions for development of the Schedule Property;

 

III. NOW KNOW ALL MEN BY THESE PRESENTS THAT, I ______________, above named, do hereby nominate, constitute and appoint MR._____________, above named, as our true and lawful Attorney, in our name and on our behalf, to do all or any of the following acts, deeds and things, in regard to the Schedule Property :-

 

(a) to represent me and act for us before all Government, Statutory, Local and other Authorities as also Courts and Tribunals in regard to or in connection with the Schedule Property;

 

(b) to have the plans prepared for demolition of the existing buildings and construction of new Building/s in the Schedule Property by engaging Architects and Structural Engineers;

 

(c) to submit applications, affidavits, statements, returns to the Government and/or the Authorities under any statute, to obtain necessary clearances, exemptions, sanctions and permissions required under the said Act;

 

(d) to apply for and obtain from all concerned Statutory Authority and other Authorities, the required Sanctions, Licences, Consents/ Permissions/No Objection Certificates/ Commencement Certificates/ Occupancy Certificates/ Amendments/ Modifications, for such demolition and construction of buildings in the Schedule Property and to apply for and obtain electrical, water and sanitary connections, and in that behalf, to sign and execute all applications, affidavits, declarations, indemnities, plans and other documents;

 

(e) to pay all rates, taxes and cesses and other outgoings in regard to the Schedule Property as also the charges for electricity and water consumed on the Schedule Property and obtain receipts therefor; and also pay all deposits/ charges/ fees, payable for obtaining licences/ sanctions/ clearances/ permissions in regard to the Schedule Property;

 

(f) to construct buildings, structures as per the Sanctioned Plans and execute any projects in the Schedule Property;

 

(g) to apply for and obtain any quotas/ permits in regard to Building Materials, if necessary;

 

(h) to sign and execute all papers/ applications for becoming member of the Owners Association and to subject the constructed area in the Schedule Property to the provisions of any Act and to sign and execute the Deed of Declaration in that behalf;

 

(i) to engage and terminate the services of Architects, Engineers, Legal Practitioners, Chartered Accountants, Contractors, Workers;

 

(j) to initiate, prosecute and defend all legal, revenue, tax and other proceedings relating to the Schedule Property and in that behalf engage the services of Legal/Tax Practitioners and be in charge of conduct of such proceedings;

 

(k) to sign and execute pleadings, applications, petitions, affidavits, declarations, undertakings, memoranda of appeal, revision and review, returns and other papers/ documents; and to accept service of orders, processes, notices and charge them; and to give evidence and to produce documents and receive them back;

 

(l) to settle, compromise, compound or withdraw any suit or proceedings relating to the Schedule Property or refer any dispute to Arbitration;

 

(m) generally to do all other acts, deeds and things necessary for or incidental to the execution of such powers or for completion of the above;

 

I hereby authorise and empower my said Attorney to delegate all or any of the aforementioned powers granted to any other person and to cancel/revoke such delegated powers to other person;

 

I HEREBY AGREE AND UNDERTAKE TO RATIFY AND CONFIRM all and whatsoever my said Attorneys may lawfully do pursuant to this Power of Attorney.
